Hello, Mr. and Mrs. Middle & Working Class Reader™

The Foreign Intelligence Surveillance Act (FISA) was introduced as a senate bill (S. 1566) on May 18, 1977, by 10 senators, including 2 republicans (Garn of Utah & Mathias of Maryland) & 8 democrats (Kennedy of Massachusetts; Bayh of Indiana; Eastland of Mississippi; Huddleston of Kentucky; Inouye of Hawaii, a Medal of Honor recipient; McClellan of Arkansas; Nelson of Wisconsin & Thurmond of South Carolina, an army reserve major general).

All are now dead except for Garn, now 87-years old and retired. A democrat president who is now 95 years old (James Earl Carter) signed the legislation into law on October 25, 1978. It has been amended several times.

After analysis & synthesis, we here at OKJackGroup conclude that both the act itself and its subsequent amendments are at best confusing and at worst unconstitutional, i.e., in violation of Amendment IV of the Bill of Rights, to wit: The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

Said another way, there is absolutely nothing in the Constitution's Bill of Rights, or in the basic Constitution or any other amendment that in any way, shape or form constitutionalizes Secret Judges, Secret Courts and/or Secret Warrants!

In other words, Secret Judges, Secret Courts and/or Secret Warrants are simply unconstitutional!

Therefore, we here at OKJackGroup recommend that any federal and/or state statute and/or local ordnance that "allow" any such unconstitutional Secret Judges, Secret Courts and/or Secret Warrants be immediately repealed because they are null and void in the first place, i.e., no more enforceable than a blank sheet of paper!

In summary, so called FISA "abuse" (i.e., "abuse" of FISA) is not the issue, but rather a clever diversion. Rather, FISA is the abuse itself, i.e., FISA abuses the Constitution, The People & The Republic, and is used by Congress and the supreme Court to abuse the President & the Presidency!
